Deferred Disposition
Deferred Disposition Request Form
This option will keep this violation from appearing on your driving record. If you choose this option you will be making an agreement with the court that you will NOT receive any other convictions during the probationary period set by the Court. The probationary period is from 1 to 180 days. You are obligated to pay the fee set by the Court and the terms of the agreement. Once you successfully complete the probationary period, you will submit a notarized affidavit of compliance, any additional documents required by the Court, and fees that are due. At this time your case will not be reported to DPS, which means it will not appear on your driving record. If you fail to comply with the terms above, you must appear before the judge for a show cause hearing. If you do not appear, the case will be a conviction.
If you are under age 25 and request deferred disposition for ticket dismissal, you must attend a driving safety course. If you hold a provisional license, you are also required to take an examination at the Department of Public Safety (DPS) and pay the fee to DPS for that test.
This option does not apply to those with a Commercial Driver’s License.
